Using the Uniformd Platform

The Uniformd Shop is a web application provided by Uniformd, a service provided by Elemental Concept 2016 Limited (hereinafter referred to as “Uniformd” or “we/us/our”). These Terms and Conditions of Use (“Terms”) apply to the Uniformd web application located at www.app.uniformd.co.uk.

By accessing, or using Uniformd, you agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree to these Terms, please do not use Uniformd.

We reserve the right, at our sole discretion, without a notice, to revise, add or remove portions of these Terms, at any time. Every time you make a purchase via the Uniformd Shop you will be required to accept the latest version of these Terms.

About you

To purchase items via Uniformd, you need to:
- Be at least 16 years old
- Have a credit card or debit card that we accept and
- Be authorised to use that credit or debit card (i.e. it is in your name and you have permission to use it)

Our relationship

We are a platform provider acting as commercial agents for participating schools/assocations. We give no warranty nor accept any liability in relation to the available products or purchase process. The products and fulfilment of orders remain the sole responsibility of the participating school/association.

Placing an order

When you place an order, you should receive an acknowledgement e-mail confirming receipt of your order.

Payment processing

Payment of items purchased on the Uniformd application are processed through a third-party payment provider. Full payment terms and conditions can be found at Stripe. Very occasionally we may not be able to process an order if, for example, there is a technical difficulty or the third-party payment provider notices something unusual. In such cases, your Uniformd administrator will be in contact.

Returns and refunds

Returns and refunds are purely at the discretion of your school. You should contact your Uniformd administrator if you require a refund.

Collections

Any collections of purchased items are to be arranged directly with you and the participating school/association.

Item descriptions

All items are listed to the Uniformd application independently by participating schools. We do not warrant that item descriptions or application content is accurate, free of errors, complete or current. Any disputes arising from a purchase must be resolved between you - the purchaser - and the participating school/association.

Privacy

Your use of our services is subject to the Uniformd Privacy Policy.

Information we collect

Non-personal information
We may collect anonymised non-personal information for troubleshooting and analytics.

Information you provide
We will collect some limited information when you purchase via the platform. Information may include:  

• Title and Name 

• Address (optional) 

• Email address 

• Telephone number (optional) 

• Payment details (for processing by payment provider, Stripe) 

• Student name and class/form (optional) 

• Dietary requirements (optional) 

We do not hold bank details or other personal information other than what is described above. 

How We Use Information
We use your information to provide you with the services we advertise. We do not sell, trade, or otherwise transfer your information to outside parties.

Third Parties
Third parties used for payment processing will collect necessary information to process a transaction. Please refer to Stripe Terms and Conditions and Privacy Policy.

Acceptable use

You must not use Uniformd in any way that causes, or may cause, damage to the application or impairment of the availability or accessibility of the application; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any such activity.

You must not attempt to gain unauthorised access to Uniformd or any portion of this application or any other networks connected to this application and Uniformd servers, either by hacking, or any other illegitimate means.

You must not use this application to store, host, transmit, send, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) to access, copy, or monitor any part of this website, or use this application to transmit and/or send unsolicited commercial communications. We reserve the right to embargo any such activity.

Intellectual property

You are allowed to store, print and display content only for your own personal use. You are not allowed to use any part of the application for commercial purposes unless you have our express permission.

You are also not allowed to use the Uniformd logo or any Uniformd brand or trademark (or any marks which are colourably similar) without our express permission.

Availability

We endeavour to always make Uniformd available, but we cannot be liable if, for any reason, Uniformd is unavailable for any period of time. Access to this application may be suspended at any time without any notice being given.

Restricted access

We reserve the right to restrict access to some areas of Uniformd or this entire application, at our own discretion. If we provide you with user account (username and password) to enable you to access restricted areas of this application, you must ensure that the username and password are kept confidential. We will not and cannot be liable for any damage or loss arising from your failure to comply with these obligations. We may disable your username and password at our sole discretion without prior notice or explanation.

Limited liability

You agree that to the fullest extent permitted by law in each applicable jurisdiction, Uniformd, its officers, directors, shareholders, employees, affiliates and/or agents shall not be liable for any damages whatsoever, including but not limited to:

1. Errors, mistakes, or inaccuracies of or in any content;

2. Any personal injury or property damage related to your use of the Uniformd application;

3. Any unauthorised access to or use of our servers and/or any personal information and/or other information stored therein;

4. Any interruption or cessation of transmission

5. The use or display of any content posted, emailed, transmitted, or otherwise made available via the Uniformd application

6. Events including any internet failures, equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms or any other adverse weather conditions, earthquakes, explosions, acts of God, war, terrorism, governmental actions, orders of courts, agencies or tribunals or non-performance of third parties; and/or

7. Loss of use, data, profits, goodwill, or other intangible losses, resulting from the use or the inability to use the Uniformd application.

In no event shall Uniformd or its officers, directors, shareholders, employees, affiliates, or agents be liable for any indirect, incidental, special, punitive, or consequential damages, whether based on warranty, contract, tort, or any other legal theory, even if Uniformd has been advised of the possibility of such damages.

Indemnity

You accept that, as a limited liability entity, Elemental Concept has an interest in limiting the personal liability of its officers and employees. You agree to indemnify and hold Uniformd, its employees, officers, directors, agents, affiliates, sub-contractors and subsidiaries, harmless from any claims, expenses, loses or liability in connection with your use of Uniformd.

Violation of these terms of use

If you breach these Terms and Conditions of Use in any way, we may take such action as we deem appropriate to deal with the breach. This may include suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the Uniformd, contacting your Internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Governing law and jurisdiction

Your use of this website shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of use of this website shall be referred to the English courts.

Changes to our Terms and Conditions of Use

We may update these Terms and Conditions of Use from time to time by posting a new version on our website. You will be asked to agree to the latest version of these terms each time you make a purchase via Uniformd. These Terms were last updated on 26th July 2023 and replace all other Terms and Conditions of Use previously applicable.
